Welcome to Mosaica AI, a service provided by CS Development LLC ("Company," "we," "us," or "our").
These Terms and Conditions of Service (these "Terms") govern the use of our services by all users and other individuals ("Users," "you," as applicable) who download, install, register with, access, or utilize ("Use," "Using") our mobile application Mosaica AI ("Mosaica" or "application") and our website located at https://www.mosaica.ai/ ("Website").
These Terms constitute a legally binding agreement between you and us. By using Mosaica AI, you accept and agree to be bound by these Terms on your own behalf or on behalf of the person or entity you represent. If you are using Mosaica AI on behalf of another individual or entity, you confirm that you have the authority to accept these Terms on their behalf and that said individual or entity agrees to assume responsibility to us in the event of any violation of these Terms.
If you disagree with these Terms, please refrain from using Mosaica AI. Your continued use of Mosaica AI signifies your acknowledgment and acceptance of these Terms.

Mosaica offers an AI-powered service that generates stylized images ("Generated Images") from user-uploaded images, applying the user's chosen stylization filters.
The content you submit through the Mosaica AI mobile application is a subject to our Privacy Policy.
We might introduce alterations, expansions, or enhancements to the application without prior notice. Furthermore, we retain the prerogative to discontinue the operation of the application, or selectively disable certain features, at any given time. Your usage of the application does not guarantee ongoing access to the application's services.
By using the Mosaica AI service, you affirm that you are at least 18 years of age or meet the minimum age of digital consent in your jurisdiction. If you are below this age, a parent or legal guardian must accept these terms on your behalf.
Our team moderates the AI model's settings in order to achieve the best results, but a possibility remains that you might come across content that you consider unsuitable for your preferences. Parents or legal guardians who permit their children to use the service assume all responsibility for the child’s activities on Mosaica AI, including the appropriateness of Generated Images in light of any legal restrictions in their country.
You may need an account to access certain features of Mosaica AI. Ensure that your account information is accurate and up-to-date. You are responsible for maintaining the security of your account.
You can establish your Mosaica AI account using an account from the application store or marketplace from which you downloaded Mosaica AI (e.g., Apple App Store, Google Play, etc.). By using such a third-party account to register your Mosaica AI account, you grant Mosaica AI permission to access your third-party Account as authorized by the applicable terms of use of the corresponding service.
Subject to these Terms and Conditions, you are granted the right to use the Generated Images for any lawful purpose, including commercial activities such as transferring rights to the Generated Images or integrating them into derivative intellectual creations.

Violations of the content policy or any aspect of these terms may result in the deletion of user-uploaded and Generated Images without prior notification.

All ownership rights, including intellectual property rights associated with Mosaica AI and related products, remain reserved. Users are not granted any of these rights by using the service.
As a registered user, you are granted a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use Mosaica AI application for your personal use.
Users retain ownership of content they upload (User Generated Content). However, Mosaica AI reserves the right to use this content to enhance, operate, and promote the service, in accordance with its privacy policy. Hence, for the sole purpose of operating or enhancing Mosaica AI, you grant us an enduring, non-revocable, nonexclusive, royalty-free, global, fully-paid, transferable, sub-licensable license to utilize, modify, distribute, create derivative works from your User Content, without further compensation to you.
This license remains in effect until you delete the User Content from Mosaica AI's library or terminate your account.
Users assume all responsibility for their content, ensuring they possess the necessary rights and permissions for any uploaded materials.
We offer both free and paid functionalities in Mosaica AI, including subscription plans with enhanced services and features. If you're over 18 years old (or of the legal majority age where you reside, if different), you can purchase and use these services through third-party platforms like the iOS App Store or Google Play. Subscriptions purchased through third parties automatically renew unless you cancel before the next billing period. We reserve the right to modify, terminate, or change subscription plans. For refunds or management of Purchased Content, please contact the relevant third party (Apple App Store or Google Play).
Due to privacy and security reasons, we cannot access or modify financial transactions from Apple or Google in-app subscriptions. Instead, contact Apple or Google support for refunds.
You can cancel Purchased Content by signing into your account and following the provided instructions for cancellation.
For Google in-app subscription refunds, refer to Google Play's refund policy.
For Apple in-app subscription refunds, follow Apple's guidance.
However, regardless of the circumstances, we aren't obligated to provide refunds for Purchased Content, and you won't receive compensation for unused Purchased Content, whether your loss was voluntary or involuntary.
The Mosaica AI service is provided on an "as-is" and "as available" basis. The service does not guarantee its completeness, accuracy, reliability, suitability, or availability of the service or its content.
The Mosaica AI service makes no warranties regarding user content and is not liable for its unauthorized use.
The service is not responsible for any User Generated Content that is lost, altered, deleted, or otherwise made unavailable, whether due to technical issues, user actions, or any other reasons. Users are solely responsible for backing up and ensuring the security of any User Generated Content they contribute or rely upon.
The Mosaica AI service may modify or replace any of the present Terms and Conditions of Service, or change, suspend, or discontinue the Service (including without limitation, the availability of any feature, database, or content) at any time. The users are responsible for reviewing the Terms of Service regularly. The continued use of the Service after any changes applied to the Terms and Conditions of Service implies acceptance by the user of those changes.
Disputes arising from these terms will be governed by Georgian law, regardless of the user's location. Unauthorized use of Mosaica AI without accepting these terms is strictly prohibited.
The Mosaica AI service, its associates, and affiliates disclaim liability for any indirect, incidental, or consequential damages arising from:
The total liability of the Mosaica AI service for any claim related to these Terms is limited to the amount you have paid, if any, for using Mosaica AI.
Users agree to indemnify Mosaica AI against all claims and expenses arising from content they upload or their use of the Mosaica AI service, including any violation of these Terms, violation or infringement of any rights of third parties. This indemnity includes reimbursement to the Mosaica AI service for any applicable court costs and expenses of litigation, including but not limited to reasonable attorneys’ fees, and reimbursement for any losses and liabilities of the Mosaica AI service.
We have the right, at our sole discretion and without prior notice, to terminate your ability to use Mosaica AI. We are not liable for any losses or damages that may result from your inability to use Mosaica AI. In the event of termination, discontinuation, or cancellation of Mosaica AI, certain provisions of these Terms that naturally should continue to apply will remain in effect. These include ownership terms, warranty disclaimers, limitations of liability, and dispute resolution provisions.
You agree to receive electronic communications from us, including emails and push notifications, related to Mosaica AI and its content. If you wish to stop receiving promotional emails from us, you can unsubscribe by clicking the unsubscribe links provided in our promotional emails.
We welcome feedback about Mosaica AI, which may be used for various purposes. You can provide your feedback by emailing us at info@mosaica.ai or through reviews on the Apple App Store or Google Play. Please, note that your feedback is not considered confidential and will become our exclusive property once submitted.
We'll possess full rights, including intellectual property rights, to your feedback. This gives us the freedom to use and share your feedback for any purpose, whether commercial or otherwise, without any obligation to acknowledge or compensate you. You also have the right to update or amend your feedback, which we'll consider to provide accurate information to other users about Mosaica AI's user experience. If we decide to make your feedback public, we won't use your personal data unless you explicitly give consent.
